Principles Applied in Examination of the Requests for an Interim Measure through the
Individual Application Mechanism
The principles in examining the requests for an interim measure within the scope of individual application mechanism are as follows:
- Requests for an interim measure received by the Court on working days by 4. p.m. shall be examined by the Court on the same day; and those received after 4.00 p.m. shall be examined on the following day.
- Such requests received by the Court by 5.00 p.m. on Fridays or on the day before public holidays shall be examined on the same day while those received after 5.00 p.m. shall be examined on the first working day following the end of the holiday.
- In case of a request for an interim measure through an individual application lodged with the Court, the request and the reasons thereof must be stated in the relevant part of the individual application form titled “The request for an interim measure and the reasons, if any”. In the event that the request for an interim measure and its reasons are not stated in this part, the Court shall not make any assessment as to the interim measure.
- Pursuant to Article 73 § 1 of the Internal Regulations of the Constitutional Court, an interim measure may be ordered only if it is considered that a serious threat exists against the applicant’s life or his/her physical or moral integrity.
